Liquidation is a non-contentious procedure in which, during the winding-up of an insolvent debtor without a legal successor, the creditors obtain satisfaction. Liquidation proceedings may be initiated by any creditor — that is, anyone whose invoiced claim the company concerned has failed to pay.

The initiation of the proceedings is subject to strict formal requirements, and even during its preparation it is necessary to observe the rules that will later facilitate, and indeed make possible, the initiation of the liquidation.
